Shia LaBeouf will not face charges of driving under the influence following his car crash in July.
The 'Transformers' star - who was cited with misdemeanor DUI charges while he was still at the hospital following the accident on July 27 - has escaped prosecution.
Criminal charges will instead be filed against the other driver, who reportedly ran a red light, causing the crash which crushed Shia's hand.
Jane Robison, a spokesperson for the Los Angeles County District Attorney's Office, said : "After reviewing the case, we've declined to file any charges against Mr. LaBeouf due to insufficient evidence."
Shia's attorney Michael Norris added: "We're very happy with the prosecutor's decision, and we're glad this whole thing resolved without Shia having to go to court."
However, the 22-year-old actor could still have his driving license suspended when he faces the Department of Motor Vehicles in a hearing.
Los Angeles County Sheriff's spokesman Steve Whitmore explained: "When an individual refuses to take a blood alcohol test, that person's license is automatically suspended for six to nine months."
