Lawyers for Smith's onetime boyfriend Larry Birkhead yesterday morning issued an emergency motion for DNA samples to prove he is the baby's father.
Birkhead and Stern, as well as Smith's estranged mother Virgi Arthur, are also battling over custody of the body of the famous blonde, whose life and death were marked by legal wrangling, controversy and scandals.

her life.
The actress is movie bosses' first choice to star as the Playboy Playmate
who married an 89-year-old oil billionaire and died aged just 39 last week.
After a failed teenage marriage she moved to Houston to become a stripper
and met elderly oil billionaire J. Howard Marshall.
Anna Nicole, 26, married Marshall, 89, in 1994, but he died the following
year. She spent the next decade battling his family for his estate.
She got her big break in 1991 when Playboy boss Hugh Hefner chose her to
appear on the magazine cover.
A source revealed: "You couldn't make up a life story like Anna's. Studios
are falling over themselves to pay tribute to an incredible woman. There are
a number of actresses earmarked to play Anna, with Charlize the favourite."
This won't be the first time the 31-year-old South African has played a
controversial real-life character.
Charlize won an Oscar in 2004 for her portrayal of US serial killer Aileen
Wuornos in 'Monster'.
And finally, Anna Nicole Smith's will names Howard K. Stern as executor of her estate, CNN reports.
The will was written in 2001 reports PEOPLE.

It was also reported today that Anna Nicole Smith was obsessed with death and already had a dress selected for her burial, a lawyer told a Broward County, Fla., judge.
During the hearing on the disposition of Smith's body, lawyers for her companion Howard K. Stern said Smith wanted to be buried with her 20-year-old son, Daniel, who died of a drug overdose Sept. 10, the New York Daily News said Friday.
Judge Larry Seidlin is presiding over matters regarding who will receive Smith's body and preserving DNA samples that would be used in paternity tests for Smith's 5-month-old daughter, Dannielynn.
Her son's death apparently triggered Smith's thoughts of her own demise, Stern's attorneys told the court. Attorney Ron Rale said Stern related that Smith had been working with a seamstress on a dress for her own funeral.
"There's a dress Anna Nicole had, the dressmaker had been preparing a dress," Rale said.
