Reese Witherspoon files for divorce from Ryan Phillippe

Reese Witherspoon has filed for divorce from Ryan Phillippe.
The Oscar-winning actress cited irreconcilable differences and has asked for
joint custody of the couple's children - seven-year-old Ava and
three-year-old Deacon - but is seeking physical custody with visitation
rights granted to her husband.

In the court papers filed Wednesday in Los Angeles Superior Court, Witherspoon, 30, also requests that the court not grant spousal support for Phillippe.

Yesterday, Phillippe issued an exclusive statement to PEOPLE , saying, “I’m not a perfect person, but I’m not guilty of a lot of the things I have been accused of. My priority is and always has been the health and safety of my family."

It was alleged last week that the cause for the break-up Ryan's affair with
Australian actress Abbie Cornish, his co-star in independent film 'Stop
Loss'.

Reese Witherspoon look-a-like , Cornish, denied the claims but sources spilling to PageSix say Cornish is in hiding. She was no show at the premiere for her new movie, "Candy," co-starring Heath Ledger. Cornish staying away from the scene at the Tribeca Grand was a big surprise, that kind of shyness is a big change from the past, according to one source, who said Cornish and Phillipe flaunted their relationship on the set of "Stop Loss." "He took her to the movies, they went to dinner, everything in public," said the spy.

Reese reportedly discovered that Ryan had romantic liaisons with co-star Abbie Cornish, from a suggestive text message, but Star uncovered that this relationship was only the beginning of a long string of unfaithfulness. Ryan was spotted with a busty brunette at the Cactus Club hotel, visited the infamous Brandi's strip club, where fellow partier Ben Affleck flirted without fiance Jennifer Lopez, and partied from dusk until the early morning.

Ryan was also accused of hard partying and drug use.

His representatives deny accusations that the 'Cruel Intentions' star has
indulged in hard partying and drug use.
But according to a source at a Santa Monica bar that Ryan used to frequent
"they would fight over that kind of thing all the time. He got away with a
lot and he knows it."

The couple first met when a mutual friend brought Phillippe to Witherspoon's 21st-birthday party. Two years later, after they had costarred in 1999's Cruel Intentions, he proposed. They married in June 1999 and had Ava three months later.

It is believed the couple did not sign a pre-nuptial agreement and under
California Law Ryan is entitled to 50 per cent of all Reese's earnings
during the marriage.
The 'Legally Blonde' actress now earns $20 million a movie while her husband
only commands $2.5 million.

In 2005 alone Reese earned $30 million dollars for 'Just Like Heaven' and
her Oscar-winning role in Johnny Cash biopic 'Walk The Line'.
Ryan has only appeared in two hit films in the last six years - 'Gosford
Park' and 'Crash'.

The divorce papers state that separate property is yet to be determined..
