The legal fight comes a week after the former Playboy Playmate's lawyer,
Howard K. Stern, said he was the child's father - claims Birkhead has
dismissed as "laughable".
Birkhead said: "I am not surprised he would say this but I am laughing at
it.
"There is absolutely no way that Stern is the father of this child. He knows
it, I know it and that's all there is to it."

Birkhead is also seeking legal and physical custody of Dannie Lynn.
In a statement, his legal spokeswoman Debra Opri said: "The public will be
very surprised when they learn the details of the lifestyle this baby is
going to be faced with if she remains in the current situation."
Meanwhile, reports that Anna Nicole has tied the knot with her lawyer have
been dismissed.
However, the 'Naked Gun 33 1/3' actress did declare her love for Stern in a
special private ceremony onboard a catamaran off Nassau in the Bahamas.

Meanwhile, a well-placed source in the celebrity magazine market says People paid Getty Images close to $1 million for photos of Smith's "wedding" to her attorney/spokesman Howard K. Stern reports RADAR.

According to the source, "They clearly staged this as a money-making thing," adds the source. "They just decided to create another photo op."
